Terms of Service
Last updated October 28, 2026
These terms are the agreement between you and the company that runs HiScore (hiscore.app) ("we", "us") when you play, sign in, buy GameBuilder tokens or build games here. By using HiScore you agree to them. Our Privacy Policy explains what we collect and why.
1. Who can use HiScore
You must be at least 13 years old to use HiScore (or older, where the law in your country sets a higher age for using an online service without a parent's consent). You may not use HiScore where the law forbids it, or if we have closed your account before.
If you are under 18, or not yet an adult where you live, you may buy GameBuilder tokens only with the permission of a parent or guardian, who agrees to these terms on your behalf and is responsible for your purchases and for what you build. Parents: tokens spent on GameBuilder turns cannot be refunded, so please talk with your child before they buy. If a purchase was made without your permission, email us and we will refund whatever of it is unspent.
2. Playing and accounts
Playing needs no account. We remember you as a guest with a cookie, and the gamer name you choose is shown beside your scores. Pick one that is not offensive and does not pretend to be someone else; we may change or hide names that break these rules.
Building an arcade needs an account, which you open by signing in with a code we text or email you (our checkout provider, Neuron Cart, sends it). Keep access to that phone and inbox secure: whoever can sign in as you can use your account, its tokens and any card saved to it. Tell us at support@hiscore.app if you think someone else has.
3. Scores and fair play
Every score is checked by replaying the round on our servers, and only the score the replay finds counts. Do not tamper with rounds, scripts, tickets or our servers to post scores you did not earn, and do not automate play. We may remove scores, reset a board, or block a player or game to keep the boards fair, and we do not owe anyone a place on a board.
4. GameBuilder tokens and payment
- What you buy. The Build your own arcade pack costs $5 (US dollars) and gives you your own arcade and500 GameBuilder tokens. More tokens are sold in packs, 100 tokens to the dollar. Prices are shown at checkout before you pay and may change for future purchases.
- How tokens are spent. Each turn with GameBuilder is charged in tokens according to the computing it actually used. GameBuilder shows what each turn cost and what is left; your account page lists every charge. A turn that fails costs nothing. A turn needs some tokens on hand to start; a turn that costs more than you have left takes what is there.
- What tokens are not. GameBuilder tokens are a prepaid allowance for using GameBuilder on HiScore. They have no cash value, are not a deposit or a stored-value account, cannot be transferred or sold, and can only be spent here. They do not expire while your account is open.
- Refunds. Within 30 days of a purchase, email support@hiscore.app from the address on the order and we will refund the part of that purchase's tokens you have not spent, to the card you paid with. Tokens already spent on GameBuilder turns are not refundable, because the computing has been used. This does not limit any right to a refund the law where you live gives you.
- Auto-reload. If you choose, you can save your card at checkout and turn on auto-reload in your account. Then, when your balance drops below the number of tokens you pick, we charge the saved card for the pack you pick, as an ordinary purchase, and never more in a calendar month (UTC) than the monthly budget you set, which cannot be more than the limit shown in your account. You see and agree to those exact terms before it starts, every reload sends you a receipt, and if your bank asks you to approve a reload nothing is charged until you do. You can change it or turn it off at any time in your account and it stops at once; a reload already charged is a purchase like any other, refundable under the rule above. If a reload is declined we try again a couple of times and then pause auto-reload and tell you.
- Payment. Payments are processed by our checkout and payment providers; we never see or store your full card number. You agree to pay any taxes that apply. If you dispute a charge with your bank instead of asking us first, we may suspend the account while the dispute is open.
- Promotional tokens we give away have no cash value, are never refunded, and may come with their own conditions.
- Gifts. You can buy GameBuilder tokens for someone else: as a gift link ($5, $10 or $25, 100 tokens for every dollar), or as the gift kit ($39: a HiScore tee and 1,000 GameBuilder tokens). A gift is a code; whoever opens its link and signs in first claims it, once, and its tokens go on their account and are treated like tokens they bought, except that they are not refundable to them. Keep the link and the code private until you mean to give them: we cannot tell who was meant to have a gift, and a claimed gift cannot be moved. Gifts do not expire. If nobody has claimed a gift within 30 days of buying it, you can ask us at support@hiscore.app for a refund of the tokens (the kit's tee follows the merch rules below). The recipient must be old enough to use HiScore under section 1.
- Merch. Every tee we sell, on its own or in the gift kit, is printed to order for you by our print partner and shipped to the address you give at checkout, within the US only for now; the price shown includes that shipping. The gift kit's note and code are printed on the slip in its box. Because each one is made for its order it cannot be cancelled once the printer has it, and it is exchanged or refunded for a fault in the print or the shirt, or for a wrong size sent, not for a change of mind: email support@hiscore.app within 30 days of delivery with a photo. Delivery times are estimates. This does not limit any right the law where you live gives you.
5. GameBuilder
GameBuilder uses third-party AI models to write and change games from what you tell it. AI output can be wrong, broken, unoriginal or not what you asked for, and the same request can produce different results. You are responsible for what you ask it to make and for reviewing a game before you publish or share it. We may refuse requests, stop a turn, or change which models GameBuilder uses. Do not use GameBuilder to try to make content these terms forbid, or to get at other people's data or our systems.
6. Your games and content
You keep whatever rights you have in what you make here: your words to GameBuilder, your arcade's name and tagline, and the games GameBuilder writes for you. AI-written material may not be protectable by copyright everywhere, and we do not promise that it is.
So that we can run HiScore, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, run, verify, display, adapt (for example to fit a screen or a share card) and distribute your content on and in connection with HiScore, including on share images and, if you make it public, on our public lists and home page. The licence ends when you delete the content, except for copies others have already shared, scores and replays already on a board, and backups kept for a limited time.
A live game or arcade plays for anyone with its link. A public one is also listed for everyone. Do not publish anything you do not want seen.
You promise you have the rights to what you put on HiScore and that it follows these terms.
7. What is not allowed
Do not use HiScore, or ask GameBuilder, to make, post or do any of the following:
- Anything illegal, or that helps someone break the law.
- Sexual content involving minors, of any kind. We report it to the authorities.
- Sexually explicit or graphically violent content, or content that harasses, threatens, bullies or demeans people, or that promotes hatred against a group.
- Content that infringes someone else's copyright, trademark, privacy or publicity rights, including games built on characters, names or logos you do not have the right to use.
- Content that pretends to be someone else, or to be made or endorsed by us.
- Code or games meant to escape the game sandbox, collect information from players, mislead players into clicking elsewhere, mine, or overload our systems.
- Scraping, load testing or probing HiScore, or getting around limits, rate limits or bans.
- Reselling HiScore or access to GameBuilder.
We may remove content, take things off the public lists, unpublish games, or suspend or close accounts that break these rules, with or without notice. We are not obliged to watch what people post, but we act on what we find and what is reported to us.
8. Reporting content and copyright complaints
To report a game, arcade or name, or to send a copyright complaint, email support@hiscore.app with a link to it and what is wrong. A copyright complaint should include: the work you say is infringed; where the infringing material is on HiScore; your name, address, phone and email; a statement that you believe in good faith the use is not authorised by the owner, its agent or the law; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for them, with your physical or electronic signature. We remove material that infringes and close the accounts of repeat infringers. If your content was removed and you believe it was a mistake, you can send us a counter-notice at the same address.
9. Our trademarks and content
The following are our trademarks, in every colour, size and form, still or animated:
- the words HiScore™, HiScored™ and GameBuilder™;
- the stylized HiScore logo: the word "HiScore" with a leaping figure as the dot of the "i";
- the stylized HiScore.app mark: the HiScore logo with ".app" set after it, as printed on our merch;
- the stylized "Hi" mark: the letters "Hi" with the leaping figure as the dot, used on its own, as the HiScore app icon and on our merch;
- the stylized GameBuilder logo: the word "GameBuilder" in the same letters, with the leaping figure as the dot of the "i" in "Builder";
- the leaping figure on its own;
- the logo's launch animation: the figure bursting from the dot of the "i" in a firework of rays that leave sparks in a circle, then settling into place, with the colour of "Score" drifting through its bands.
The logos, the marks, the figure and the animation are also artwork protected by copyright, and so are the designs of our tees. So are HiScore's design, the house games, their code, art and sounds, and the arcade's game runtime.
These terms do not give you any right to use our name, logos, figure, animation or other trademarks. You may link to HiScore and share your score pages and share images as the site lets you. Any other use, including in another product's or company's name, logo, domain or app, and any altered version or imitation of the logo, the "Hi" mark, the figure or the animation, needs our written permission.
10. Ending things
You can stop using HiScore at any time, and you can ask us to delete your account at support@hiscore.app. Deleting an account deletes its arcades and games; unspent tokens are lost, unless it is still within the refund window in section 4.
We may suspend or close an account that breaks these terms, or where the law requires. If we close your account without you having broken these terms, or we shut down GameBuilder or HiScore itself, we will refund your unspent purchased tokens.
Sections 6 (as to content already shared), 9, 11, 12, 13 and 14 survive the end of this agreement.
11. No warranties
HiScore is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that HiScore, the GameBuilder, or any game will be uninterrupted, error-free, secure, or produce any particular result. Some places do not allow these exclusions, so they may not all apply to you.
12. Limit of liability
To the extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from HiScore or these terms; and our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim and US$50. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.
13. Your responsibility to us
If someone brings a claim against us because of content you posted or your breaking these terms or the law, you will cover our reasonable losses and costs from it, to the extent the law allows. This does not apply to consumers where local law forbids it.
14. Law and disputes
These terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-law rules. Before bringing a claim, please email us and give us 30 days to try to put it right. Any dispute goes to the state or federal courts in Cook County, Illinois, and you and we agree to their jurisdiction. If you are a consumer living in the European Union, the United Kingdom or another country whose law gives you the right, you also keep the protection of the mandatory laws of your country and may bring a claim in your local courts.
15. Changes and the rest
We may update these terms. If a change is significant we will say so on the site, or email account holders, before it takes effect; using HiScore after that means you accept the new terms. If any part of these terms cannot be enforced, the rest still applies. Not enforcing a part is not a waiver of it. Throughout these terms, "we" and "us" mean HISCORE LLC, an Illinois limited liability company, which runs HiScore and owns the trademarks in section 9. You may not transfer these terms; we may, to whoever takes over HiScore. These terms and the Privacy Policy are the whole agreement between us about HiScore.
